1. Acceptance of Terms

By accessing or using stayupdatedwith.ai (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and stayupdatedwith.ai ("we," "our," or "us").

2. Description of Service

stayupdatedwith.ai is an AI-powered voice tutoring platform that enables users to learn through real-time voice conversations with AI companions (tutors). Our services include:

  • Real-time AI voice tutoring sessions across multiple subjects
  • Customizable AI companions with specific subjects, topics, and teaching styles
  • Session history tracking and learning progress monitoring
  • Credit-based usage system for voice tutoring sessions
  • Subscription plans with varying levels of access and credits

3. Account Registration

To use the Platform, you must create an account through our authentication provider (Clerk). You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or in violation of these Terms.

4. Credits and Subscription Plans

4.1 Credit System

The Platform operates on a credit-based system where 1 credit equals approximately 1 minute of voice tutoring. Credits are consumed during active voice sessions and are deducted in real-time.

4.2 Subscription Plans

We offer the following subscription tiers:

  • Free Plan — 10 credits per month
  • Starter Plan — 50 credits per month
  • Pro Plan — 150 credits per month
  • Enterprise Plan — Custom credits and features (contact sales)

4.3 Ad-Earned Credits

Users may earn additional credits by watching advertisements. Ad-earned credits are subject to a daily cap and have a limited expiry period. We reserve the right to modify the ad reward system at any time.

4.4 Credit Expiry

Plan credits expire 30 days after allocation. Ad-earned credits expire 7 days after being awarded. Unused credits do not roll over to the next billing cycle unless explicitly stated. Credits have no monetary value and cannot be exchanged, transferred, or refunded.

5. Payment and Billing

All payments are processed through Clerk Billing. By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your selected subscription plan
  • Authorize recurring charges on your payment method
  • Provide valid and up-to-date payment information

Subscription fees are billed in advance on a monthly basis. You may cancel your subscription at any time, and you will continue to have access to your plan until the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion.

6. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload, share, or generate content that is harmful, abusive, threatening, or otherwise objectionable
  • Attempt to manipulate, exploit, or abuse the credit system or ad reward system
  • Use automated tools, bots, or scripts to interact with the Platform without our consent
  • Interfere with or disrupt the Platform's infrastructure or other users' experience
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the AI tutors for any purpose other than educational learning

7. AI-Generated Content

The Platform uses artificial intelligence to generate tutoring responses. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information. The Platform is intended as a supplementary learning tool and should not be considered a replacement for professional education, certified tutors, or official academic resources.

We make no warranties regarding the accuracy, completeness, or reliability of AI-generated content. Users should verify critical information through authoritative sources.

8. Intellectual Property

The Platform, including its design, features, code, content, logos, and trademarks, is the property of stayupdatedwith.ai and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial educational purposes.

AI companions created by users remain associated with their accounts. However, the underlying AI technology, voice synthesis, and platform infrastructure remain our intellectual property.

9. Limitation of Liability

To the fullest extent permitted by applicable law, stayupdatedwith.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

  • Your use of or inability to use the Platform
  • Any errors or inaccuracies in AI-generated content
  • Unauthorized access to your account or data
  • Any interruption or cessation of the Platform's services
  • Any third-party conduct or content on the Platform

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

11. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Platform after any revisions become effective, you agree to be bound by the revised terms.
